Update: Suspension of Terms and Deadlines at the Ministry of Energy, the Energy Regulatory Commission, and the National Energy Control Center

The following agreements relating to energy-sector authorities were published today in the Official Gazette of the Federation:

(i) Ministry of Energy ("SENER"). "Agreement amending and supplementing the one establishing the suspension of legal deadlines and terms of the Ministry of Energy, as a measure to prevent and combat the spread of the COVID-19 Coronavirus" ("SENER Agreement"). (ii) Energy Regulatory Commission ("CRE"). "Agreement No. A/015/2020 amending Agreement No. A/010/2020 and A/014/2020, which establish the suspension of legal deadlines and terms of the Energy Regulatory Commission, as a measure to prevent and combat the spread of the COVID-19 coronavirus, in order to extend the suspension period" (the "CRE Agreement"). (iii) National Energy Control Center ("CENACE"). "Agreement amending the first article of the Agreement declaring the suspension of deadlines and terms in the acts and proceedings conducted before the Administrative Units of the National Energy Control Center, from Thursday, March 26 to Sunday, April 19, 2020" ("CENACE Agreement"). These Agreements provide that the suspension of the deadlines and terms of the acts and proceedings conducted before SENER, CRE, and CENACE will be extended until May 30, 2020. During such period, the actions, notifications, requirements, requests, or filings submitted before SENER, CRE, and CENACE will be deemed to have been made as of June 1, 2020. Specifically, the CRE Agreement provides that such days and hours as may be necessary will be designated during the referenced period, in order to attend to the matters that the Governing Body of the CRE and its Administrative Units consider necessary. Likewise, the CRE Agreement provides that those procurement, leasing, and services proceedings whose performance is extremely urgent or necessary for the continuity of operations for the fulfillment of the CRE's essential functions are excepted from the suspension measure provided in the Agreement. For its part, the CENACE Agreement states that the suspension of terms and deadlines applies to the procedures linked to the System for Handling Interconnection and Connection Requests (SIASIC), that is, interconnection and connection studies, as well as the execution of the respective interconnection and connection contracts. Likewise, the CENACE Agreement provides that the receipt of the Guarantee Instruments referred to in the Manual of Performance Guarantees continues to be excepted from the suspension of terms and deadlines.
