As a direct antecedent of the aforementioned procedure, on February 6, 2026, the Federal Electricity Commission (the "CFE") and the Ministry of Energy ("SENER") published the First Call for Mixed Development Schemes (the "First Call"). The First Call was aimed at the development, financing, construction, operation, and maintenance of renewable energy projects under the Mixed Investment modality in order to meet capacity requirements in various regions of the country.
As a direct antecedent of the aforementioned procedure, on February 6, 2026, the Federal Electricity Commission (the "CFE") and the Ministry of Energy ("SENER") published the First Call for Mixed Development Schemes (the "First Call"). The First Call was aimed at the development, financing, construction, operation, and maintenance of renewable energy projects under the Mixed Investment modality in order to meet capacity requirements in various regions of the country. In that context, this past June 5, 2026, the CFE issued the corresponding ruling, by means of which it awarded a total of 37 projects to 31 private-sector developers. On the other hand, the CFE rejected a total of 46 projects following the corresponding technical and financial evaluation. According to the opinions issued by the CFE, the proposals were dismissed due to a lack of bids, saturation of the transmission grid, technical unfeasibility, and financial non-compliance. Likewise, it was resolved that these bids did not guarantee the best economic conditions for the State, since they projected "Internal Rates of Return" of between 14% and 16%, in addition to monomial prices that significantly exceeded the regional reference values.
Updated Schedule of the Second Call
On May 11, 2026, SENER published in the Official Gazette of the Federation ("DOF") the "Second Call for the priority processing of applications for electric energy generation permits and interconnection to the National Electric System, aligned with the binding planning" (the "Second Call"), whose objectives, scope, and specifications may be consulted here. In light of the foregoing, on June 8, 2026, SENER published in the DOF, for the second time, the "Agreement whereby the amendment to the Second Call for the priority processing of applications for electric energy generation permits and interconnection to the National Electric System, aligned with the binding planning, is issued" (the "Amendment to the Second Call"). The Amendment to the Second Call establishes a new schedule for certain stages of the procedure, including the handling of requests for corrections, the issuance of the results of the interconnection studies, the acceptance of Interconnection Works and Reinforcement Works, as well as the granting of generation permits by the National Energy Commission ("CNE"), to read as follows:

- June 11 to 19 Requests for corrections by CENACE. Review of the interconnection studies application and, where applicable, response to the corrections formulated by CENACE.
- June 22 to 23 Determination of the payments for interconnection studies. Notification by CENACE of the amounts to be covered for studies or revalidation of prior studies.
- June 24 to July 3 Payment of interconnection studies. Accreditation of the payment made for the interconnection studies.
- July 6 to August 6 Submission of the application for the electricity generation permit. Formal submission of the application for the electricity generation permit before the CNE through the OPE.
- August 7 to 13 Review of requirements and notification of corrections by the CNE. Review and verification of the documents and information submitted and issuance of corrections by the CNE.
- August 14 to 21 Response to the corrections notified by the CNE. Submission of supplementary information and documentation to address the CNE’s corrections.
- August 24 Notification of the costs of Reinforcement Works and interconnection. Communication of the results of the studies and the costs of the Interconnection and Reinforcement Works by CENACE.
- August 25 to September 2 Express acceptance of the cost of the Interconnection Works and Reinforcement Works. Express acceptance of the costs and works determined by CENACE by means of the Works Acceptance Form.
- September 3 to 9 Reassessment of the results of the Interconnection Works and Reinforcement Works. Exceptional reassessment of the results of the studies and costs of the works due to withdrawals or other adjustments.
- September 10 to 11 Express acceptance of the cost of the redefined Interconnection Works and Reinforcement Works. Express and irrevocable confirmation of the costs and works determined by CENACE by means of the Works Acceptance Form.
