Entry into force of the Amendment to the Regulations of the General Law for Tobacco Control

The Amendment to the Regulations of the General Law for Tobacco Control recently entered into force. This amendment has a direct impact on the commercial operations of bars and restaurants, as it requires establishments that have areas exclusively for smoking to ensure that these comply with the following characteristics: Be entirely separate from the so-called 100 percent smoke-free spaces; Be located only in outdoor spaces, and never in an enclosed one; That no food and beverage service be provided in them, nor that recreational activities be carried out there; and That they be no larger than 10% of the area of an establishment, considering only the area intended for the provision of the service. Those who are interested may bring an amparo lawsuit against this new regulation and request a stay in order to continue operating normally. Please click here to download the note in PDF format.
