Yesterday, March 10, 2021, the plenary session of the Chamber of Deputies concluded the discussion of the bill for the Federal Law for the Regulation of Cannabis as part of the process for its legislative approval. Although the chamber approved many of the provisions previously discussed and approved in the Senate, it also included certain significant amendments that will have to return to the Senate itself for eventual discussion and possible approval.
Among the new features introduced by the Chamber of Deputies are: (i) the shift in the law’s focus toward regulating cannabis production rather than its various uses, (ii) the creation of a new system of permits and licenses for the production and distribution of cannabis, including an “integral” license that would cover everything from cultivation to sale to the final consumer, (iii) the production of cannabis for personal consumption would be subject to a permit, and (iv) the National Commission Against Addictions would be granted regulatory powers with respect to psychoactive cannabis. The bill approved by the Chamber of Deputies also failed to meet the expectations of the various political, economic and social sectors involved. Nevertheless, it represents the ongoing effort of the Congress of the Union to definitively approve the Federal Law for the Regulation of Cannabis by April 30, 2021 at the latest.
