Last Thursday, July 17, 2025, various complementary provisions to the 'Chair Law' were published in the Official Gazette of the Federation. These establish the risk factors associated with standing work, in order to guarantee the right to rest during the workday for workers who perform their activities standing.

These establish the risk factors associated with standing work, in order to guarantee the right to rest during the workday for workers who perform their activities standing.

These Provisions establish the minimum requirements for employers to be able to provide the sufficient number and type of seats or chairs with appropriate backrests for workers who perform their activities standing (“Standing”); especially in the service, commerce, analogous sectors, and industrial establishments, when the nature of the work allows it. Similarly, various obligations are established for the workers.

Specifically, the Provisions establish the following obligations for the employer:
• Conduct a risk analysis and identification as established in the Provisions.
• Document the risks and preventive measures in the records of the Joint Safety and Hygiene Commission.
• Determine with the Joint Commission the level of risk according to the parameters established in the Provisions.
• Provide chairs with backrests that meet ergonomic criteria (height, lumbar support, armrests, footrests).
• Implement preventive measures, such as alternating tasks to allow posture changes, providing ergonomic footwear, establishing breaks during the workday, etc.
• Refer personnel presenting discomfort or symptoms related to standing to receive necessary medical attention.

The Provisions came into force on July 17, 2025, so it is relevant to carry out the necessary activities to comply with the Provisions and the Federal Labor Law as applicable.

Entry into Force of the Chair Law

Last Tuesday, June 17, 2025, the decree commonly known as the “Chair Law” came into force, published in the Official Gazette of the Federation on December 19, 2024, through which various provisions of the Federal Labor Law were reformed and added (the “Decree”).
