Amendments to the Foreign Trade Rules issued by the Ministry of Economy

Today, the Agreement amending the one whereby the Ministry of Economy issues General Rules and Criteria on Foreign Trade Matters was published in the Official Gazette of the Federation, and will enter into force tomorrow, December 10, 2019. Among the most relevant changes, it stands out that companies operating under IMMEX and PROSEC programs may only add new premises to operate under those programs when they have previously obtained a certification of facts issued by a notary public with respect to such premises, the transmission of which to the competent authority must comply with certain requirements. Such certification of facts must specify, among other things, the status of the possession of the property and its condition, the inventory of the machinery and equipment located on the premises, the description of the merchandise to be imported, as well as the situation of the personnel hired both directly and through outsourcing. Likewise, the amendment of various sections of the so-called "NOMS Agreement" stands out, to eliminate tariff classifications that fall outside the scope of application of various Mexican Official Standards, as well as to include others subject to compliance with certain standards at the time of their importation.
