Draft regulation on cannabis for medicinal use

On July 27, 2020, the draft Regulation on Sanitary Control for the Production, Research and Medicinal Use of Cannabis and its Pharmacological Derivatives was published on the website of the National Commission for Regulatory Improvement (CONAMER). Said draft would also establish the guidelines under which the various government agencies would exercise the legal powers corresponding to them regarding authorizations for primary production, pharmaceutical production, acquisition, trade, transport, medical prescription, supply, employment, use and consumption, as well as research, importation and exportation for the aforementioned purposes. The draft regulation implements the amendments to the General Health Law and the Federal Criminal Code published in the Official Gazette of the Federation on June 19, 2017, which require the Ministry of Health to design and execute the public policies that regulate the medicinal use of the pharmacological derivatives of cannabis sativa, indica and americana or marijuana, including Tetrahydrocannabinol. It is clarified that this draft has no relation to the unconstitutionality of the absolute prohibition on the recreational use of cannabis contained in the General Health Law, which at some point will also have to be reflected in the corresponding legal provisions. The draft regulation will remain on the CONAMER website for consultation and comments by interested parties for at least 20 business days.
