Constitutional Amendment: Reduction of the Working Day.

We inform you that on March 3, 2026, in its evening edition, the Decree amending sections IV and XI of subsection “A” of article 123 of the Political Constitution of the United Mexican States regarding the reduction of the working day (the “Decree”) was published in the Official Gazette of the Federation, entering into force on the day of its publication.

The key points of the Decree are as follows: The weekly working day shall be 40 hours, which entails a reduction from 48 to 40 hours per week. For every six days of work, workers must enjoy at least one day of rest with full salary (a right currently provided for in the Federal Labor Law). Under no circumstances may the reduction of the weekly working day entail a decrease in workers' pay, salaries or benefits. A new overtime scheme is established: Overtime may not exceed 12 hours per week, which may be distributed in up to 4 hours per day over a maximum of 4 days within the same period (currently, the Federal Labor Law contemplates up to 9 overtime hours distributed over 3 days per week). The first 12 overtime hours shall be paid at an additional 100% over the salary corresponding to ordinary hours, and those exceeding said limit shall be paid at an additional 200%. Express prohibition of overtime work for minors (a provision that is already contemplated in the Federal Labor Law). As of January 1, 2027, the working day shall be reduced gradually by two hours, until reaching a maximum of 40 hours per week in 2030, in accordance with the following schedule: Year Maximum Weekly Working Day January 1, 2026 48 hours January 1, 2027 46 hours January 1, 2028 44 hours January 1, 2029 42 hours January 1, 2030 40 hours The Congress of the Union shall have a period of 90 days to make the necessary modifications and adjustments to the Federal Labor Law. In order to ensure due compliance with the new limits on the working day, it will be of great importance to begin an analysis of your current work schedules, contracts, policies and regulations, as well as to optimize processes and review payroll costs.
