Last night, a decree was published in the Official Gazette of the Federation by which the President of the Republic declares various extraordinary actions that the Ministry of Health may implement, immediately, in all regions of the country affected by the COVID-19 disease.
Among the extraordinary actions to be implemented, the Ministry of Health is empowered to use, as auxiliary elements in the control of the disease, all the medical and social assistance resources of the public, social and private sectors existing in the affected regions and in the neighboring ones. From the content of the decree, it appears that said ministry may implement it immediately in the region or regions of the country that it considers to be affected by said disease, and without the need for an additional administrative decree. Likewise, it is authorized to directly purchase all types of medical goods, and of any other kind, in the quantities or categories it deems necessary to address the contingency, without the need for a prior public tender. It is also permitted to import, and to authorize third parties to import, such goods, without having to exhaust any administrative procedure, which will undoubtedly allow private entities to effectively assist in obtaining the materials necessary to address the contingency. Finally, the Ministry of Health is empowered to adopt the measures necessary to prevent price speculation and the hoarding of the essential supplies referred to above, as well as to adopt any other measure it deems necessary to address the contingency.
