Mexico’s Position at the United Nations

The government of Mexico has submitted a document to the UN General Assembly and Security Council, dated January 13, 2025, rejecting the expansive interpretation of Article 51 of the UN Charter as a basis for justifying the use of force against non-state actors in foreign territory. In its statement, Mexico emphasizes that:

With the imminent designation of Mexican drug cartels as terrorist organizations by the current administration of the United States, Mexican companies and individuals operating in risk zones or directly or indirectly exposed to them may be subject to strict Office of Foreign Assets Control (OFAC) regulations, as well as economic penalties and criminal consequences for acts related to terrorist activities or groups, in addition to the rules specifically applicable against organizations related to drug trafficking. These regulations prohibit any financial or commercial interaction with sanctioned actors; such interactions may include extortion (e.g., “protection fees,” passage fees, or illegal tolls), threats or transactions with suspicious clients, intermediaries, or counterparties in sensitive areas. Failure to comply with these provisions can result in severe legal, financial, and reputational sanctions.

Today, the Mexican Government published a new decree in the Official Gazette of the Federation granting tax incentives as part of the “Plan Mexico”, a national strategy aimed at promoting new investments, driving technological innovation, and strengthening local and regional value chains. This decree seeks to boost job creation and economic development through incentives directed at both domestic and foreign companies.

On 19 December 2024, a Decree published in the Official Journal of the Federation (DOF) prohibited the temporary importation of certain goods from the textile and clothing sector. This measure significantly disrupted industry operations, compelling companies to suspend activities and adjust their supply chains due to restricted access to critical inputs. The sector experienced widespread unease, raising concerns about the potential economic consequences of this provision.

On January 10th, 2025, the National Institute of Statistics and Geography (INEGI) published in the Official Federal Gazette (DOF) the updated daily, monthly and annual values of the Measurement and Updating Unit (UMA), with an increase of 4.21%. These new values will come into effect on February 1st. 2025.

On December 24, 2024, an amendment to the Federal Labor Law (“LFT”) regulating digital platform work was published in the Official Federal Gazette (“DOF”). This reform introduces new provisions establishing rights and obligations for both workers and managers of digital platforms (the “Reform”).

The Electronic Bidding and Opinion Request System (SISELO) of the Federal Economic Competition Commission (COFECE) starts operations

On June 8, 2023, NOM-037-STPS-2023 issued by the Ministry of Labor and Social Welfare (“STPS”) was published in the Official Gazette of the Federation (“DOF”), which establishes the safety and health conditions for workers performing Telework, in order to prevent accidents and illnesses, as well as promote a safe and healthy environment
in the place of work (hereinafter “NOM-037”).

On 8 June 2023, the Supreme Court of Justice (SCJN) ruled on the constitutional complaint filed by the Federal Commission for Economic Competition (processed under case no. 94/2021), annulling the decree which enacted the Law for the Transparency, Prevention, and Combat of Improper Practices in Advertising Contracting, considering that the Congress of the Union had violated the legislative procedure.

On June 5, 2023, the “Decree promoting investment by taxpayers who carry out productive economic activities within the Development Poles for the Welfare of the Isthmus of Tehuantepec” was published in the Federal Official Gazette (DOF). This decree grants important tax benefits and administrative facilities to taxpayers who carry out certain productive economic activities in these poles.

On May 29, 2023, Resolution number A/018/2023 (the “Resolution”) of the Energy Regulatory Commission (“CRE”) entered into force, which generates a negative impact on the energy transition through various modifications to the applicable regulations to efficient cogeneration systems and, indirectly, has a significant impact on the form and requirements for the issuance of Clean Energy Certificates (“CELs”), as described below:

On May 18, 2023, the Resolution establishing the merchandise whose importation is subject to regulation of the Ministry of Labor and Social Welfare (the “Resolution”) published jointly by the Ministry of Economy (“SE”) and the Ministry of Labor and Social Welfare (STPS”), entered into force.
