Nallely advises national and international corporations, as well as individuals, in intellectual property matters, including the filing of distinctive signs, collective trademarks, certification trademarks and domain names in Mexico and in international bodies, such as WIPO. She conducts searches to determine viability of use and registration at the Mexican Industrial Property Institute (IMPI) and international bodies. She also analyzes and responds to provisional refusals, official notices of requirements, prior registrations, legal impediments, trademark registration denials and opposition proceedings. She has advised companies in the design and implementation of legal strategies that expand the protection of their intellectual property rights; in the analysis of direct and indirect competition and legal risks; in due diligence procedures; in the appropriate classification of products and services according to the Nice Classification and IMPI’s criteria; in the determination of strategies for the defense of rights in opposition proceedings; and in the preparation, negotiation and execution of assignment contracts, license and franchise agreements and co-existence agreements, including registration at IMPI and international offices.
