New Obligations for Employers: Gender Equality, Prevention and Eradication of Discrimination and Violence

February, 2026

A January 2026 decree amended Mexican legislation to strengthen employers' obligations on gender equality and the prevention and eradication of discrimination and violence.

On January 15, 2026, a decree was published in Mexico’s Official Gazette amending several laws, including the Federal Labor Law, to strengthen substantive equality between women and men and prevent discrimination and violence against women in the workplace.

The main changes include enhanced requirements regarding working conditions under substantive equality principles, employee training to prevent and eliminate violence against women, and reinforced obligations for employers and employees to maintain workplaces free from discrimination and violence.

The reform makes it particularly important for employers to review their internal policies, protocols and training programs to ensure compliance with the new requirements.
