We would like to inform you that on May 15, 2026, the Ministry of the Interior, together with the Ministry of Foreign Affairs, amended the General Guidelines for the Issuance of Visas, introducing changes that affect various categories of residence visas, including the Temporary Resident Visa for a Job Offer.
The most relevant new requirements are as follows: Employers must provide additional information in the job-offer letters submitted as part of applications for a Temporary Resident Visa for a Job Offer. The newly required information includes the work modality (on-site, remote, or hybrid), the precise place where services will be rendered, including the complete address, confirmation of the salary amount, and the frequency of salary payment. Immigration authorities may, at their discretion, request evidence of the foreign national's technical or professional capabilities, including academic degrees, certifications, and other professional credentials, even in the case of directive, executive, or managerial personnel. For positions considered part of a “strategic project” that involve highly specialized knowledge, the immigration authorities may require employers to include, directly in the job-offer letter, a detailed program for the transfer of knowledge and training for Mexican nationals. Although the Migration Law and its regulatory framework have historically contemplated obligations related to the transfer of knowledge, these provisions were rarely enforced in practice and generally did not form part of the ordinary requirements of immigration procedures. It is expected that, in the coming months, the authorities will issue additional criteria and implementation guidelines for the application of these reforms. Such clarifications could address, among other aspects, the definition of “strategic project,” the scope of the requirements for verifying professional credentials, the acceptable formats for supporting documentation, and the circumstances under which knowledge-transfer programs will be applicable. These new provisions and requirements could affect the preparation and resolution times of immigration procedures, as well as increase the documentation required for the hiring and international mobility of foreign personnel.
