Reforms to the Federal Labor Law

On September 28, 2012, the Chamber of Deputies of the Congress of the Union approved a decree amending various provisions of the Federal Labor Law (Ley Federal del Trabajo (LFT)). Such decree was sent to the Chamber of Senators of the Congress of the Union as the reviewing chamber. On October 24, that legislative body approved the decree making certain changes (only adding 8 articles regarding union life and transparency) and returned it to the Chamber of Deputies for its review (and possible approval) of the changes made by the Senators.

Subsequently, the Chamber of Deputies approved the majority of the additions sent by the Senators, with the exception of two amended articles and the complete elimination of two other articles completely. Consequently, such minute was again sent to the Senate for its review.

Federal Act to Prevent and Identify Transactions Involving Illicit Funds
January, 2013
On October 17, 2012, a decree issuing the Federal Act to Prevent and Identify Transactions Involving Illicit Funds (the “Act”) was published in the Official Federal Gazette. The law will become effective as from nine months after its publication that is on July 17, 2013.

The Law sets forth a prohibition regime for certain activities, as well as procedures and rules to identify and report certain acts and transactions that could be used for money laundry or terrorism financing.

New Immigration Law in Mexico
December, 2012
On September 28th, 2012 a new Regulation of the Immigration Law of Mexico (the Regulation) was published in the Mexican Official Gazette and became effective on November 9th, 2012.
 
December 27th, 2012.
 
The regulations regarding the General Law of Population on migratory control, verification and regulation were annulled, including the Manual on Criteria and Migratory Procedures of the National Institute of Migration through which the present visa designations of Non Immigrant, Immigrant and Immigrated were defined. Anyone with a current visa (FM-2 or FM-3) can continue to use their current visa until the expiration date, at which point they will have to renew under one of the categories outlined below.
