Mexico´s current federal administration has publicly made de fight against corruption one of its top priorities. In the Pact for Mexico, President Peña Nieto proposed the implementation of reforms to strengthen transparency, accountability and the fight against corruption.

In Mexico, a subcontracting regime (understood as the regime through which an employer as contractor executes works provides services with its workers who are dependent upon it, to a beneficiary, individual or entity, which establishes the work of the contractor and supervises it in the performance of the services of execution of the works contracted) has been generally associated with outsourcing and with all forms of subcontracting or provision of services and works between companies of the same business group.

The important changes recently made in Mexico to the antitrust law are considered a big step for our country, legislatively as well as in practice. In this regard, it is important to have a legal system that provides for efficiency, continuity and success in these kinds of operations, always maintaining the necessary control over the markets in order to avoid monopolies and incentivise fair competition.

In line with the political decision of totally transforming the functioning, nature and purpose of “Petróleos Mexicanos” and the “Comisión Federal de Electricidad” [Federal Agency of Electric Power] into “productive enterprises of the State” total freedom has been given to them in order resolve any dispute in the agreements they execute with private enterprise.
